Hearing on pleas against military trials

The Petition hearing regarding civilians' trials in military courts was suddenly adjourned on Thursday after Justice Qazi Isa objected to the nine-member bench hearing the case. 

He was of the opinion that he didn't get the chance to be part of the bench when a case related to snatching suo moto Power from the office of the Chief Justice of Pakistan (CJP), was decided. 

The nine-member bench was comprised of Chief Justice of Pakistan (CJP) Umar Ata Bandial, Justice Qazi Faez Isa, Justice Sardar Tariq Mas­o­­od, Justice Ijazul Ahsan, Justice Syed Mansoor Ali Shah, Justice Munib Akhtar, Justice Yayha Afridi, Justice Sayyed Ma­­zahar Ali Akbar Naqvi and Justice Ayesha Malik.

The petition was filed by renowned personalities like former CJP Jawwad S. Khawaja, Aitzaz Ahsan, Karamat Ali, and PTI Chairman Imran Khan.

Khawaja requested the top court to declare the trials of civilians in military courts unconstitutional. 

In his petition, ex-Premier and Chairman of PTI Imran Khan sought a declaration against the arrests, investigation, and trial of civilians in peacetime under the Pakistan Army Act 1952 and the Official Secrets Act 1923.

Justice Qazi Isa gave remarks that Article 175 of the Constitution provisioned courts the right to hear cases. Mistakes happen, we are all human. I can also make mistakes,” he said.
